Web Site Terms and Conditions of Use

This policy is designed to provide conditions for the internal and external use of Embedded Systems Australia's (ESA) and NICTA’s websites and these terms cover the use of and deployment of content via ESA & NICTA’s internal and external websites. 

Authorisation is required to access parts of this site. Do not hack or crack the site. You should not share your password with anyone.

Don’t send SPAM from the site and please don’t SPAM us.  No one really believes you are the second cousin of a member of a royal family, that you’ll actually send them the generic drug of their choice, provide good investment advice nor be able to re-grow my hair. 

Don’t send viruses, worms or other harmful code to or from the site.  It’s not very nice and also illegal in many places.

Don’t pick fights or use personal insults, obscenities, racial slurs or make statements that may be defamatory or harassing.

Show respect and restraint in dealing with any topic particularly those that may be considered sensitive, objectionable or inflammatory.  Remember, many people view politics, religion and sexual orientation as sensitive or private issues.  Also, don’t upload porn or offensive material.

Exercise caution when linking to another person’s web-page or product (e.g. software) and comply with requirements they have when linking to their site.  You do not have any control over their content and any association with a particular site may reflect badly on you.

While it is ok to talk about your work, make sure you don’t post confidential information to this site without the consent of the owner.  If you are unsure, check with your manager or legal advisor.  Publish quality material and don’t post information which is misleading or deceptive or make claims which cannot be substantiated.

Be particularly considerate when dealing with personal information and be sure that you comply with privacy laws.  Consider your and other’s privacy concerns as what you write may be indexed and is likely to be in the public domain for a long time.

Don’t post intellectual property to the site without the owner’s consent.  Please don’t upload or post any content that infringes someone else’s intellectual property rights.  For example, you must get the permission of the copyright owner if you want to upload a copyright work.  Also consider what terms you’ll use when it is posted (any license should be approved by the legal department if you work at NICTA).  Similarly, if you want to use someone’s trademark on the site then ask them first.  You may however use a trademark to refer to someone’s trademark product, e.g. Apple iPod device or Microsoft Word software.

Remember that whatever you post will reflect not just on you but on the reputation of your colleagues and company; so do not post anything that you, your colleagues or your grandmother would not be proud of, or would not want to see appear on the front page of the newspaper.  Check your spelling and grammar, and if you are representing NICTA you should familiarise yourself with the requirements of NICTA’s Branding Policy and Corporate Visual Language (CVL) Manual.

ESA & NICTA reserves the right to take away your access to its web site(s).  ESA & NICTA shall have the right (but not the obligation) in its sole discretion to alter, delete or remove any content that is available via the web site(s) without prior notice.

You acknowledge that access to the web site is at your own risk and you agree to take responsibility for your use of the web site(s).  ESA & NICTA shall not be liable to you or anyone else for any loss or damage arising in connection with use of the web site(s) or a linked web site.  To the extent permitted by applicable law, ESA & NICTA disclaim of express or implied conditions, representations and warranties of any kind.

If you think someone has broken these rules, or you would like to provide feedback, or make a complaint about any of the content included on this site, then please let the webmaster or administrator know and we’ll investigate and take whatever action is appropriate.
